1. General

1.1 These Terms of Sale apply to all vehicles sold by FF Automotive ("the Dealer") to a customer ("the Customer").

1.2 By purchasing a vehicle from FF Automotive, the Customer agrees to these Terms of Sale.

1.3 These Terms do not affect or limit any statutory rights the Customer may have under applicable UK consumer law.

 

2. Vehicle Description

2.1 Vehicle details, including mileage, specification, registration date, engine size, transmission, colour and equipment, are provided in good faith based on information available to the Dealer.

2.2 Customers are advised to satisfy themselves that the vehicle is suitable for their requirements and to check the vehicle's specification and condition before purchase.

2.3 Any known faults, defects or significant issues identified by the Dealer will be disclosed to the Customer where applicable.

2.4 Photographs used in advertisements are for illustration purposes and may not show every minor cosmetic imperfection.

3. Vehicle Inspection and Test Drive

3.1 Customers are encouraged to inspect and, where appropriate, test drive the vehicle before purchase.

3.2 A test drive may be subject to the Customer providing a valid driving licence and satisfying the Dealer's insurance requirements.

3.3 The Customer is responsible for driving the vehicle safely and in accordance with UK road traffic laws during any test drive.

 

4. Vehicle Condition

4.1 Used vehicles are sold according to their age, mileage and condition.

4.2 Customers purchasing a used vehicle should expect reasonable signs of previous use, including cosmetic wear consistent with the vehicle's age and mileage.

4.3 The Dealer will not describe a vehicle as being in a condition that is materially different from its known condition.

4.4 Where a vehicle is sold as a trade sale, spares or repairs, or for a specific disclosed purpose, this will be clearly stated before the sale.

 

5. Consumer Rights

5.1 Where the Customer purchases a vehicle as a consumer, their statutory rights under applicable UK consumer legislation are not excluded or restricted by these Terms.

5.2 Vehicles must meet the requirements applicable to consumer sales, including being of satisfactory quality, fit for purpose where required, and as described.

5.3 Nothing in these Terms prevents a Customer from exercising rights available to them under the Consumer Rights Act 2015 or other applicable legislation.

 

6. Payment

6.1 The vehicle must be paid for in full, or finance arrangements completed and approved, before the vehicle is released unless otherwise agreed in writing.

6.2 Accepted payment methods will be confirmed by the Dealer.

6.3 The Dealer reserves the right to delay vehicle collection or delivery until cleared funds have been received.

6.4 Any deposit paid to reserve a vehicle will be subject to the terms agreed with the Customer at the time the deposit is taken.

 

7. Part Exchange

7.1 Where a vehicle is offered as part exchange, the valuation is based on information supplied by the Customer and the vehicle's condition at the time of inspection.

7.2 The Customer must disclose any known faults, accident damage, outstanding finance, warning lights, modifications or other material information relating to the part-exchange vehicle.

7.3 If the condition or history of a part-exchange vehicle differs materially from that disclosed, the Dealer reserves the right to revise the agreed valuation.

 

8. Vehicle Collection and Delivery

8.1 The Customer is responsible for ensuring that the vehicle is appropriately insured and legally permitted to be driven on public roads before driving it away.

8.2 Where delivery is arranged, the Customer must provide accurate delivery information and ensure someone is available to accept the vehicle where required.

8.3 Delivery times are estimates unless a specific delivery date has been expressly agreed in writing.

 

9. Warranty

9.1 Any additional warranty provided with a vehicle will be subject to the terms, conditions and exclusions of the applicable warranty policy.

9.2 A warranty does not replace or restrict the Customer's statutory rights.

9.3 Customers should report any suspected fault to the Dealer as soon as reasonably practicable after discovering it.

 

10. Returns and Faults

10.1 If a Customer believes that a vehicle has a fault or does not comply with their statutory rights, they should contact FF Automotive promptly so that the matter can be investigated.

10.2 Depending on the circumstances and the Customer's legal rights, the Dealer may be entitled to inspect, repair or otherwise remedy an issue before any further remedy is considered.

10.3 Nothing in these Terms removes or limits any legal rights available to consumers.

 

11. Cancellation and Distance Sales

11.1 Where a vehicle is purchased entirely at a distance, without the Customer visiting the dealership to inspect or purchase the vehicle in person, additional cancellation rights may apply under UK consumer legislation.

11.2 Where applicable, these rights will be explained to the Customer before the contract is completed.

11.3 Any cancellation rights do not affect the Customer's other statutory rights.

 

12. Vehicle Modifications

12.1 The Customer should make the Dealer aware of any intended modifications or alterations that may affect the vehicle's operation, warranty or insurance.

12.2 The Dealer accepts no responsibility for problems caused by modifications carried out after purchase by the Customer or by a third party.

 

13. Complaints

13.1 FF Automotive aims to resolve any concerns promptly and fairly.

13.2 Customers should initially contact the dealership with details of their complaint, including the vehicle registration number, date of purchase and nature of the concern.

13.3 The Dealer will investigate the complaint and communicate the proposed resolution where appropriate.

 

14. Pricing and Advertising

14.1 Vehicle prices and specifications are subject to availability and may be changed or withdrawn without notice before a sale is agreed.

14.2 Advertisements may contain errors or omissions. Any material error identified before completion of the sale will be brought to the Customer's attention.

14.3 A vehicle is not considered sold until the Dealer has accepted the Customer's offer and the agreed transaction has been confirmed.

 

15. Liability

15.1 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

15.2 The Dealer does not accept liability for loss or damage caused by circumstances outside its reasonable control, subject to the Customer's statutory rights.

 

16. Governing Law

16.1 These Terms of Sale are governed by the laws of England and Wales.

16.2 Any dispute will be dealt with in accordance with applicable UK law and the Customer's statutory rights.
